Under Provisional Measure No. 1,394 of 25 September 2026, all fixed-odds betting licences in Brazil are extinguished on 25 October 2026. This news item covers what ends on that date, what is already in force and what is still undecided.

What ends on 25 October
Article 4 of the measure extinguishes licences, permissions and concessions for fixed-odds betting on grounds of public interest. An operator cannot claim back the authorisation fee and receives no compensation from the state. Article 5 adds that the extinction does not stop the Secretariat of Prizes and Bets from reviewing what happened while the licence was in force.
Already in force
Sites and apps had to be unavailable from 6 October. Banks and payment institutions may not process transactions for such betting, and Central Bank Resolution No. 590 makes this binding from 25 September. Advertising, marketing and sponsorship aimed at the Brazilian public is banned. Article 1 also covers companies abroad that offer bets to people in Brazil, so a foreign licence does not change the position.
What is still open
Congress has to convert the measure into law. The first 60 days of its validity end on 23 November, and the period can be extended once. Two actions challenging the measure are before the Federal Supreme Court (ADI 8024 and ADI 8027), with Justice Luiz Fux as rapporteur. According to the case page on 21 October, the request to suspend the measure was with the rapporteur and no decision had been published.
What to do
Operators and affiliates should keep Brazilian traffic switched off, and payment providers should keep suspending payments linked to Brazilian betting until the position changes. We go through the measure article by article in our full article on Brazil’s betting ban.
