Token coin on a glass slab next to brass scales

Preparing a crypto startup for MiCA requirements before entering the EU market

Result

Token sale launched on schedule

The compliance package was ready before listing, and no regulatory objections arose at launch.

  • ClientWeb3 startup from Eastern Europe
  • PracticeCrypto
  • JurisdictionsEU (MiCA)

The client’s task

The client planned to launch a token sale and enter the European market, but did not know which MiCA requirements applied to it or how to build compliance before launch. The difficulty was that the product combined features of a utility token and a payment service, and the time left before listing was limited.

Challenges and risks

  • Uncertain classification of the token under MiCA
  • No ready-made AML/KYC procedures
  • Risk of regulatory objections and a blocked listing due to incomplete compliance

What we did

  1. Carried out a legal review of the product and classified the token
  2. Prepared the white paper and token sale documents
  3. Developed an AML/KYC policy
  4. Prepared agreements with the platform and investors (SAFT/token warrant)
  5. Supported communication with the regulator and counterparties
